OnCue Talent – Terms & Conditions & Refund Policy


Important Summary
OnCue Talent does not charge joining or membership fees. Fees paid relate to professional services, including the configuration and ongoing management of
your casting profile, which commences once setup begins and is non-refundable except where required by Australian Consumer Law. OnCue Talent acts as a talent agency and cannot guarantee work. A commission of up to 10% applies to work booked through the agency. Representation may be suspended or terminated at OnCue Talent’s discretion. Additional state-based rules may apply depending on where you are located or engaged for work. Full details are set out below.


Terms & Conditions of Representation

Upon registration with OnCue Talent, you agree to the following Terms & Conditions:

 


1. Professional Conduct

You agree to:

  • Act professionally at all times while on set
  • Arrive on set on time as instructed by the production company
  • Wear closed-in shoes on set unless otherwise directed by production
  • Follow all reasonable directions given by OnCue Talent and the production company

Failure to meet professional standards may result in suspension or termination of representation.


2. Representation & Profile Accuracy

You agree to:

  • Give permission for OnCue Talent to represent you and submit your profile for roles you meet the criteria for
  • Ensure your online profile details remain accurate and current
  • Ensure any images used on your profile are a true representation of your current appearance
  • Not upload non-professional images or personal contact details to your profile unless requested by your Talent Agent
  • Maintain a valid mobile phone number (with messaging enabled) and email address

3. Eligibility to Work

You acknowledge that:

  • To be represented and to complete work, you must be an Australian resident or hold a valid Australian working visa
  • If you are over the age of 18, you must hold a valid Tax File Number (TFN) for Feature Film and Television work
  • Certain Commercial, Corporate, or Promotional roles may require an Australian Business Number (ABN)

4. Casting Profile Fees

You acknowledge and agree that:

  • OnCue Talent does not charge any joining or membership fees
  • A fee is payable for the configuration and establishment of a professional casting profile
  • This fee relates to the setup and configuration of one casting profile by OnCue Talent
  • Any additional profiles created on other platforms are the responsibility of the talent unless otherwise agreed in writing

OnCue Talent may, from time to time, introduce additional fees relating to profile maintenance, updates, renewals, or ongoing services. Any such fees will be disclosed prior to being charged.

Once casting profile configuration or maintenance services have commenced, all applicable fees are non-refundable, except where required by Australian Consumer Law.


5. Commission & Fees

You agree that OnCue Talent will charge a commission of no more than 10% of the gross fee earned for any Film, Television, Commercial, or related performance work.

Where state or territory legislation imposes a lower maximum commission or fee, commissions will be capped at the maximum amount permitted by law.


6. Payments

You acknowledge that:

  • Production companies are responsible for payment of wages, tax, superannuation, and any statutory entitlements
  • Once payment is received by OnCue Talent, the applicable commission is deducted
  • The remaining balance is paid directly into your nominated bank account
  • A payment advice and breakdown will be provided via email

7. Payment Responsibility

You remain responsible for payment of all fees properly charged in accordance with these Terms & Conditions, regardless of whether a payment is processed, declined, delayed, or reversed by a financial institution or payment provider.

OnCue Talent reserves the right, where permitted by law, to suspend services or recover outstanding amounts where payment has not been successfully completed.

Nothing in this clause limits or excludes any rights or remedies available under Australian Consumer Law.


8. Media & Promotion

You agree that your images, likeness, and testimonial comments may be used on OnCue Talent’s website and social media platforms for promotional purposes.


9. On-Set Rules & Conduct

You agree that:

  • Alcohol or illegal drugs are strictly prohibited before or during work, including breaks
  • Harassment of any kind toward OnCue Talent staff, fellow talent, or clients will not be tolerated
  • Cameras, including mobile phone cameras, are strictly prohibited on set unless authorised by production
  • Personal belongings brought onto set are your own responsibility

Breaches may result in removal from set, non-payment, and/or termination of representation.


10. Exclusivity

You confirm that you are not exclusively represented by another agency.

If another agency is entitled to commission for work booked and completed through OnCue Talent, that commission will be deducted from your earnings.


11. Scheduling

OnCue Talent reserves the right to cancel or reschedule Information Sessions, appointments, or services where required.


12. Communications

You agree to receive phone calls, text messages, and emails from or on behalf of OnCue Talent, including but not limited to:

  • Information Session reminders
  • Representation discussions
  • Booking confirmations and role notifications

13. Jurisdiction-Specific Acknowledgements

Queensland-Based Talent

If you are ordinarily resident in Queensland or primarily engaged by OnCue Talent for work performed in Queensland, you acknowledge that:

  • The engagement of performers’ representatives in Queensland is regulated under applicable Queensland legislation
  • You have been advised that further information regarding performers’ agents and their obligations is available through Queensland Government and Fair Trading resources
  • You agree to engage with OnCue Talent in accordance with the applicable Queensland regulatory framework

New South Wales-Based Talent

If you are ordinarily resident in New South Wales or primarily engaged by OnCue Talent for work performed in New South Wales, you acknowledge that:

  • The engagement of performers’ representatives in New South Wales is regulated under the Entertainment Industry Act 2013 (NSW)
  • You have been advised that an Information Sheet outlining your rights and obligations is available and forms part of your engagement with OnCue Talent
  • You agree to engage with OnCue Talent in accordance with the applicable New South Wales entertainment industry laws

14. Breach of Terms

Any breach of these Terms & Conditions may result in suspension or termination of representation at the discretion of OnCue Talent.


15. Termination of Representation

OnCue Talent reserves the right to suspend or terminate representation at any time, with or without notice, at its sole discretion.

Termination of representation does not entitle the talent to any refund of fees already paid.


Refund Policy

OnCue Talent does not charge any joining or membership fees.

All services provided by OnCue Talent are considered professional services.

Casting Profile Configuration & Maintenance Fees

This section applies to fees charged for the configuration, establishment, or ongoing maintenance of a professional casting profile, where applicable.

Fees paid for these services are non-refundable once the service has commenced.

This includes (but is not limited to):

  • Profile setup and configuration
  • Formatting and optimisation
  • Onboarding and database entry
  • Submission readiness
  • Profile maintenance, updates, or renewals

No refunds will be provided for:

  • Change of mind
  • Personal circumstances
  • Dissatisfaction with outcomes unrelated to the service provided
  • Termination of representation

Refunds will only be provided where expressly required under Australian Consumer Law.

Nothing in this Refund Policy excludes, restricts, or modifies any rights or remedies available under Australian Consumer Law.
